• Distributing new data files intended for use with a program is not infringing
  
  • Example: HTML templates for a web application
  • Example: Themes for a window manager
  • Example: Icons for a word processor
    
• Unless the new data files themselves are derived from old data files
  
  • Example: new maps or quests for video games
    
    • except "total conversions"
