Data files distributed with a program are part of a single work with that program
Distributing new data files intended for use with a program is not infringing
Example: HTML templates for a web application
Example: Themes for a window manager
Example: Icons for a word processor
Unless the new data files themselves are derived from old data files
Example: new maps or quests for video games
except "total conversions"
